The police are being sued in Hammond Indiana for excessive force, false arrest and battery after a traffic stop for not wearing a seat belt resulted a passenger being tasered for not exiting the vehicle.

Lisa Mahone and her boyfriend Jamal Jones were driving September 25th when they were pulled over for wearing their seat belts.  Officers ask Jones for his id but he didn’t have his licence on him.   Officers drew their guns on Jones after he refused to exit the vehicle.  According to the police this went on for 13 minutes before the busted out the passenger side window with a axe and tasered Jones pulling him from the car.

The entire incident was caught on tape by their 14 year old son that was in the back seat with his sister.  The children received minor cuts from the broken glass.

Hammond police said, “Police officers who make legal traffic stops are allowed to ask passengers inside of a stopped vehicle for identification and to request that they exit a stopped vehicle for the officer’s safety without a requirement of reasonable suspicion. When the passenger displayed movements inside of the stopped vehicle that included placing his hand in places where the officer could not see, officers’ concerns for their safety were heightened.”
