One Chicago business owner crossed the line with the wrong woman when he slapped a judge while yelling racial remarks at her.

David Nicosia is behind bars after attacking Judge Arnette Hubard, 79, while she was smoking outside of the Daley Center on Monday. The Chicago Tribune reports that David was annoyed that she was having a cigarette in his general vicinity, so he started an argument with her.

 

The situation escalated when he approached her, spitting on her and shouting, “Rosa Parks, move.” Arnette was not going to let him get away so she followed him while calling for help as he tried to make his escape. That’s when he spun around to spit on her again and slap her twice.

Moments later cops arrived to arrest David. He was promplty charged with four counts of aggravated battery and a hate crime. The next day, Judge James Brown ordered that he be held on $90,000 bail.

 

Having started her law career in 1969, some of the first cases Arnette worked on had to odo with civil rights. She also spent several terms on Chicago’s election, and she was appointed to her judgeship in 1997. Most recently, she was re-elected to her position in 2010. Arnette has also been a huge advocate for women’s rights.

Arnette’s were astounded that anyone would attack her. “People of good common sense and decency, people of good hearts should be outraged by this,” said her friend Delores Robinson, who once served as the president of the Cook County Bar Association. “Not just because of who she is but that this happened to anybody.”
